What the Fair Housing Act Covers
The Fair Housing Act (FHA) requires landlords to provide reasonable accommodation for individuals with a qualifying emotional support animal. Under federal law, an ESA is not considered a pet.
Because of this distinction, housing providers typically cannot apply pet policies, charge pet deposits or rent, or enforce breed and weight restrictions on a qualified ESA.
